AMENDMENT TO ORDINANCE NO. 35,543 - BY: COUNCILMEMBERS WILLARD AND MCCARRON
Brief:
An amendment to Ordinance Calendar Number 35,543 to:
• Expand the definition of chief procurement officer;
• Add executive determination of contractor responsibility for professional services contracts procured by the executive branch;
• Provide that the city shall not enter into a contract with a non-responsible contractor;
• Add a timeline within which a responsibility hearing takes place after a preliminary determination;
• Clarify situations in which administrative hearings are not required;
• Clarify that the director of the department procuring a contract and the chief procurement officer do not require a complaint from a third party to initiate an investigation;
• Add that administrative hearings are conducted in accordance with procedures promulgated by the chief procurement officer; and
• Require regular reporting from the chief administrative officer on waivers to this division.
