Brief:

An amendment to Ordinance Calendar Number 35,384 to:

 

                     To delay the effectiveness of amended Section 138-57 until January 1, 2028 and to provide for a fixed fee sanitation fee model in the interim, beginning October 1, 2026;

                     Adjust the fee calculation in Section 138-57 to apportion costs based on billed service locations, rather than locations receiving service;

                     Allow for reductions in the fee calculation to ensure equitable apportionment of sanitation fees among bill payers;

                     Add provisions requiring periodic billing audits and other billing safeguards;

                     Create definitions in Section 138-2 for “unit” and “unoccupied property” to ensure consistency in the application of the Code;

                     Clarify what constitutes a five-unit “location” to conform to current eligibility requirements;

                     Increase the volume limits applicable to service locations outside the French Quarter and Downtown Development District to align eligibility/fee thresholds with current collection practices;

                     Revise, clarify, and streamline the eligibility requirements and procedures in Section 138-58 relative to the litter abatement fee; and

                     Make stylistic and technical changes to ensure clarity and consistency of terminology.
